White House accuses Moonshot AI of covert distillation and banned Nvidia chip use to build Kimi K3
The White House publicly accused Chinese AI lab Moonshot AI of covertly distilling U.S. models and illegally accessing export-controlled NVIDIA chips to build Kimi K3, the model that stunned the industry with its capabilities when it launched July 17. Treasury Secretary Scott Bessent followed with a warning that sanctions could be on the table.

Kratsios also alleged large-scale model distillation -- training a new model by extracting knowledge from an existing one's outputs -- targeting U.S. labs, specifically Anthropic's Fable model. He said Moonshot "developed a sophisticated internal platform to conduct large scale distillation against U.S. models, allowing them to quickly switch between multiple methods of access to avoid detection." Kratsios drew a line between ordinary industry practice and what he described as Moonshot's conduct: "large-scale, covert industrial distillation aimed at stealing proprietary U.S. technology and undermining American research is unacceptable."
Treasury Secretary Scott Bessent then raised the stakes, saying "sanctions and Entity List designations will be on the table" for firms conducting covert, industrial-scale distillation that crosses into IP theft, adding: "Open source is not open season on American IP." An Entity List designation would restrict Moonshot's ability to buy from U.S. suppliers, including chipmakers.
Not every detail is settled: some experts quoted in coverage question whether Kimi K3 could have been built primarily through distillation of Fable, since Fable itself only became publicly available on July 1, 2026 -- roughly two weeks before Kimi K3 shipped, a tight window for the kind of large-scale distillation being alleged.

Kimi K3 launched July 17 as a 2.8-trillion-parameter model that immediately matched or closely rivaled frontier systems from Anthropic and OpenAI on coding benchmarks, drawing significant attention in part because of how quickly Moonshot reached that level of performance. This is the latest flashpoint in an ongoing U.S.-China dispute over chip export controls and model IP: Washington has repeatedly tightened restrictions on advanced NVIDIA chips reaching China, while Chinese labs have found workarounds and leaned further into open-source and efficient-training approaches, narrowing the capability gap despite the restrictions.
